Valencia, 12 ene (EFE).- The Constitutional Court (TC) has accepted for processing the appeal for protection presented by the professor of International Law and secretary of the Institute of Human Rights of the University of Valencia (IDH), José Elías Esteve, para revisar la validez del archivo del llamado "caso Tíbet".
Esteve has acted as a lawyer for the Tibet Support Committee against the decision to file the case, in which several leaders of the People's Republic of China, among them former president Jiang Zemin and former Prime Minister Li Peg, were charged with genocide, as a consequence of the reform approved by the Rajoy Government in March 2014.
As reported by the UV in a statement, The filing of the Tibet case also caused the closure of other cases opened in Spain but that affected the international arena., like Guantanamo, the Couso case, the one known as the Freedom Flotilla against Israeli authorities or Falun Gong, and was ratified on 6 May 2015 by the Supreme Court.
An appeal for protection was filed against said verdict before the Constitutional Court., considering that the legal reform of universal justice violated different precepts of the Spanish Constitution, indicate the same sources.
According to Esteve, la admisión a trámite de su recurso por el Tribunal Constitucional "abre de nuevo la puerta a la esperanza no únicamente a las víctimas tibetanas, sino a la de otros graves conflictos que habían quedado abandonadas".
Ha añadido al respecto que "el que los jueces debatan con profundidad la controvertida modificación de la ley de jurisdicción universal, abre de nuevo el debate por el cual el derecho internacional no puede quedar relegado a un segundo plano".
For your part, the director of the Tibet Support Committee, Alan Cantos, ha señalado que la decisión del TC "no solo se abre la esperanza de no dejar tiradas en la cuneta a las víctimas del Tíbet y de otros tantos casos, but to alleviate national and international shame, restableciendo la Justicia Universal en España donde su aplicación era ejemplar y admirada".
In the coming months the judges of the Constitutional Court will decide if the reform of universal justice is unconstitutional, which would force the case to be reopened, or that the matter be filed again, In the latter case, the European Court of Human Rights in Strasbourg remains the last resort..
