Madrid, 21 abr (EFE).- The Supreme Court will study tomorrow, in a plenary session of its Criminal Chamber, Whether or not the filing of the cases linked to the so-called Universal Justice that investigated the genocide in Tibet and the attacks on the Falung Gong sect was correct or not., both linked to China.
These cases were investigated in the National Court and archived after the reform that in 2014 limited the scope of universal jurisdiction provided for by the Organic Law of the Judiciary for Spanish justice.
The Supreme Court will resolve the appeals of those affected against the filing of these two cases with a decision that will generate general jurisprudence on the scope of universal jurisdiction.
Nonetheless, Several sections of the Supreme Court are studying other cases related to Universal Justice but not to China throughout the month of April in informal meetings.: the murders of the religious Ignacio Ellacuría and the diplomat Carmelo Soria, next to the case of the Freedom Fleet.
The Ellacuría cases, Soria and Fleet of Freedom have reached the high court in the form of a question or presentation of the National Court, so that the Supreme Court indicates whether or not the file corresponds depending on whether or not an adequate judicial investigation of the events was carried out in the countries where the events occurred..
The universal jurisdiction provided for by the Organic Law of the Judiciary was reformed in 2014 by the Popular Group in Congress to limit its reach.
The law resulting from that reform greatly limits the scope of universal jurisdiction, although it allows the National Court to investigate crimes against humanity committed abroad if the accused are in Spain, alguna de las víctimas tiene nacionalidad española o "existe algún vínculo de conexión relevante en España".
She further , It is necessary to demonstrate that the courts of the country where the events took place have not carried out the prosecution or judicial investigation of them., issue that is key in the Ellacuría cases, Soria and Freedom Fleet.
