EUROPA PRESS: The president of the FxJ criticizes that the Government makes the “blind eye” with Universal Justice for “pressures”

VALENCIA, 23 Feb. (EUROPA PRESS) –

The president of the second section of the Provincial Court of Valencia and the Foundation for Justice (FxJ), José María Tomás and Tío, ha criticado que el Gobierno central "mire para otro sitio" y haga la "vista gorda" for the reform that restricts Universal Justice, y lamenta que España se someta a "presiones" que son "incomprensibles".

Judge Tomás y Tío spoke this way in an interview with Europa Press, in relation to the approval by Congress of the Universal Justice reform proposed by the PP, with the en bloc rejection of the parliamentary opposition. This initiative will mean the filing of dozens of cases opened in the National Court, like the case of Tibet.

In your opinion, el Estado "no puede hacer la vista gorda, mirar para otro sitio cuando está descubriendo que ha suscrito un convenio internacional y ha sometido a la Justicia Universal determinados hechos". Al magistrado le parece "tremendo" What matters are the Spanish justice system investigating?, and being one of the judicial systems that was most committed to human rights, "ahora esté mirando para otro lado, turning to the rear, y sometiéndose yo creo que a presiones que son incomprensibles".

The magistrate has the feeling that Spain, at this point, "ha cedido ante presiones de otra naturaleza, como ya cedió en la anterior modificación de la Ley Orgánica sobre el tema de la Justicia Universal". The article 23 of this regulation –has added– "ya es la segunda vez que se modifica, always for the interests of other countries. At that time it was Israel, y posiblemente ahora será por China".

Asked for his opinion about one of the justifications given by the PP for approving this modification, when he assures that he does not want to create false expectations because the majority of international cases end up being archived, has responded: "cuando tu pones todos los mecanismos para que se archiven los asuntos, al final acaban archivándose".

"Lo que quizá no se acaba de entender bien –has pointed out– is that the right of the victims to the truth is the first of the rights that every victim has. And the right to the truth, if a State is not capable of establishing the mechanisms that accredit it, alguien en el mundo tendrá la obligación de buscarlo", has stood out.

In this line, ha expuesto que "está claro" that in Spain they are not going to bring all international criminals to serve prison sentences, and they are not even going to establish reparation mechanisms in another country, "pero una declaración de un órgano judicial independiente y vinculado al imperio de la ley, of responsibility, tiene una fuerza impresionante para las víctimas".

PÉRDIDA "ABSOLUTA" OF RIGHTS

About it, He has commented that he has personally traveled to Tibet to observe what has happened to human rights., y ha lamentado que es un país "secuestrado por otro": "se vive la esclavitud y la pérdida más absoluta de cualquier derecho que pueda uno reclamar en su nombre".

"La gente del Tibet –has narrated– is leaving another country to go to the territory ceded by India on the other side of the Himalayas, and the 40 days that the furtive transit usually lasts crossing the Himalayas, there are tremendous risks, porque durante el día puedes ser ametrallado por la vigilancia de la propia China".

In your understanding, la situación del Tibet es "espeluznante, torture is permanent, There are people who are in prison without trial for many years, la situación es de vulneración evidente de los derechos humanos". But right now, has regretted, China "es un poder demasiado fuerte en el mundo y es capaz de marcar el calendario incluso a organizaciones internacionales que no se atreven a rechistar".

RIGHTS OF PEOPLE

The magistrate has invoked the right of people to know the truth, and in this regard he has recalled the ruling of the V International Court for the application of Restorative Justice in El Salvador that declares the States of El Salvador and Honduras responsible for torture, disappearances and massacres. This resolution aims to restore justice for a high number of victims in the state of El Salvador. Specifically, eleven of them in addition to the child that one of them was carrying in her womb, for extrajudicial executions; four, for deprivation of liberty and torture; one for forced disappearance, and finally, an indeterminate and unidentified number, for the Lempa River massacre.

About it, Tomás y Tío has commented that the International Court –who presides– It is constituted as an instrument for searching for the truth, "porque el primer derecho de las víctimas es el derecho a la verdad". The second is the right to be asked for forgiveness.; and the third to repair: "el derecho a la verdad requiere saber qué ha pasado", has asserted.

In this line, has given as an example the truth that one of the victims of El Salvador was finally able to tell in court, a woman who testified about what she had to go through 20 years after the events were recorded: "cuando llega al tribunal y lo cuenta, luego se transforma", has highlighted. "Y solamente porque ha podido contar la verdad y porque alguien le ha llamado de tú", has underlined.

This victim had to flee the territory along with his sister when one of the multiple atrocities took place in the country., and suffered torture and rape. After that, passed 23 years without telling anyone anything, not even her husband. "Era una mujer destrozada, with some shortcomings and some reservations, con un dolor dentro y una tristeza".

Until the last day –the magistrate has reproduced– en el tribunal no sabían si la mujer iba a acudir porque "no se atrevía a hablar, porque le daba vergüenza contar lo que vivió". Finally he went and between sobs he relayed what he suffered. "Era una mujer destrozada, We treat you with a lot of respect., con reverencia", has described.

When he finished his story –has asserted–, The members of the court stood up and he personally asked if he could give him a hug., to which she replied: "hace 25 I waited years for someone to hug me. Es tremendo", has asserted. After declaring, se convirtió en una mujer "extrovertida, radiant, que se había transformado". "Esto es una experiencia de restauración tan grande que solo hace falta escuchar", has concluded.
